Using Mediation to Resolve Your Family Law Concerns

We can help you use mediation or arbitration to avoid the time and expense of divorce litigation. In mediation proceedings, you work with a neutral third party to find mutually beneficial ways to resolve your differences. The mediator will listen to your explanation of the situation, but will not take testimony, consider legal arguments or render a decision. Instead, the mediator will act as a facilitator, helping you work with the other party to come to agreement.

In family law or divorce mediation, we can act as your advocate, representing your interests before the mediator, or we can serve as the neutral mediator. If we serve as the mediator, we won't represent you, but will work with you to bring about a successful resolution.

We encourage clients to consider mediation for a number of reasons:

  • mediation gives you more control of the outcome, so that you don't have to depend on the ruling of a court
  • mediation is often less-expensive, as you can avoid most of the expense associated with trial
  • mediation often produces results in a more timely fashion — you don't have to wait for time on the court's docket

If you reach agreement in mediation, we will help you prepare an agreement setting forth the terms, which will be enforceable in a court of law.

Arbitration in Family Law Matters

In arbitration, you bring your issues before an expert or panel of experts, who will ultimately tell you how they believe the case should be resolved. Arbitration can be binding (you must accept the panel's decision) or non-binding (you may reject the panel's finding).

In arbitration proceedings, we will act as your advocate, presenting evidence to the panel and making legal arguments to support your position. Like mediation, arbitration can help you minimize the time and expense necessary to settle your divorce issues.
