Types of Orders That Can Be Modified

Post-judgment modifications can address three categories of family court orders. Each has its own legal standard and its own procedural requirements in Somerset County.

Child Support

Child support modifications address changes to the amount one parent pays, based on updated income figures, changes in the child’s needs, or shifts in parenting time. Alimony

Alimony modifications address changes to the amount, duration, or continuation of spousal support. Common triggering circumstances include a significant income change for either party, the supported spouse’s cohabitation, or a serious health event. Under New Jersey law, a supported spouse’s remarriage automatically terminates permanent and limited-duration alimony rather than triggering a modification. Like child support modifications, alimony modification motions in Somerset County require a current Case Information Statement.

The Substantial Change in Circumstances Standard

New Jersey courts require a substantial and unanticipated change in circumstances before granting any modification. The change must be material enough that enforcing the original order would be unfair, and the burden falls on the party seeking the modification to establish it.

• Job loss or significant income reduction determined to be more than temporary
• Serious illness or disability affecting a party’s ability to work or a child’s care needs
• A parent’s relocation that materially affects the parenting arrangement

The Modification Process in Somerset County

For contested custody disputes, the court may require mandatory mediation before scheduling a hearing. Where both parties are open to an agreement, negotiation or mediation can produce a consent order filed with the court rather than a litigated result and generally moves more quickly than a contested hearing.
